Senator Snowe urges IRS to adopt NPRC Recommendations NPRC members met with Senator Snowe's office to provide an update on suggested IRS regulatory changes. NPRC recommendations would ensure that clients of payroll service firms are reminded of their liability for payroll taxes and advised how to verify that tax payments are being credited appropriately. Senator Snowe subsequently wrote to the IRS Commissioner to urge prompt adoption.

NPRC members met with the Senate Finance Committee and House Ways and Means Committee to provide recommendations on a Social Security Tax Holiday concept and the Obama Administration's proposed “Making Work Pay” Tax Credit.
NPRC formally requested regulatory changes to require disclosures and make EFTPS mandatory for Reporting Agents, to enable clients to confirm tax deposits made on their behalf. The IRS Chief Counsel organization adopted the project within the annual Guidance Priority Plan.
NPRC was successful in seeking appropriate exclusions from the IRS “Return Preparer” penalty regulations. Proposed rules may have made payroll services liable for tax positions taken by clients, even if the service provider did not give tax advice or exercise discretion (such as determining whether workers are employees or independent contractors).
NPRC met with NACHA to confirm how the new International ACH Transaction (IAT) rules would affect payroll taxes. Funding from outside U.S. territorial borders generally triggers the IAT requirement for every related ACH transaction, including payments to government agencies (e.g., tax withholding, child support withholding etc.). NPRC requested a broad exemption for such payments.

NPRC members were credited with improving burdensome new IRS electronic filing security and privacy rules that would have applied broadly to all tax-related data collection via the Internet in 2009.
State Issues|Electronic Filing
Throughout 2007 and 2008, NPRC members focused extensively on helping states shape new electronic filing systems, through conference presentations, letters and agency meetings. Key letters and presentation materials are posted.
State Issues|Industry Legislation
New York introduced the Payroll Processors Act of 2008, which included quarterly accounting of funds; disclosure of how to contact tax authorities; advertising restrictions; state licensing; and audits. NPRC provided written testimony suggesting that they focus on disclosure requirements rather than active regulatory oversight. The bill was not enacted.
A 2008 Minnesota tax bill made payroll services responsible for withholding from payments to independent contractors. NPRC asked DOR officials to remove the reference, and the legislature enacted the amendment sought.
The Alabama Department of Revenue proposed regulations to make it responsible for payroll service providers. Provisions included registration, audits, suspension of licenses if the state perceived a risk of loss to clients, etc. NPRC requested and the DOR adopted changes to clarify that the requirements relate only to electronic filing requirements.
State Unemployment Insurance Issues|Electronic filing
A long-awaited NPRC position paper on electronic filing systems was finally released that explains why states should not calculate taxable wages and tax due for employers (i.e., large employers and bulk filers should be able to opt out).
2008

S. B. 1773, as introduced in 2007, would regulate payroll service companies. The bill reflects NPRC recommendations, although members continue to pursue a regulatory mandate to require payroll service providers to make routine disclosures to clients.
NPRC wrote to the IRS Taxpayer Advocate to announce a strengthened proposal to require disclosures and make EFTPS mandatory for Reporting Agents, to enable clients to confirm tax deposits made on their behalf.
A 2007 Tax bill broadened the scope of ‘Return Preparer’ provisions to include employment tax returns, and made “preparers” liable for positions taken by clients. NPRC has asked that payroll service providers be excluded from the regulations under the category of providing “mechanical assistance”.

NPRC revised recommendations for electronic filing of ‘Final’ W-2s, suggesting that Final Forms W-2 be considered timely if filed electronically by March 31.
NPRC members expressed concerns regarding the new Form 941X, and IRS’ emphasis on freeform explanations, and restrictions on requests for refund.

NPRC agreed to hire a national consulting firm to help us influence the design of next-generation state electronic filing systems.
NPRC’s nominee Nadine Hughes of Compupay was accepted to the IRS Information Reporting Program Advisory Council (IRPAC) for 2007 - 2009.
NPRC representative Ken Nirenberg received an award for his efforts as Chair of the SB/SE IRS Advisory Committee.

NPRC wrote to Congress about the tax-relief proposals being considered in the economic stimulus package. Some proposals would have created significant burdens for employers and payroll service providers.

The IRS provides guidance as to how to report ‘catch-up’ elective deferral contributions on Forms W-2, in accordance with the recent TGTRRA tax legislation.

Members explored emerging two-dimensional bar code technology for W-2s with states. 2-D Bar codes enable tax preparers to import W-2 information directly into tax preparation software for faster, easier, error free tax returns.

NPRC asked the Louisiana Department of Revenue to rescind a policy requiring client signatures and notarization on letters requesting abatements. The Department agreed that payroll service providers could sign such letters when they have actual knowledge of the facts and circumstances in question.
State Unemployment | Insurance Issues
NPRC expressed support of Massachusetts regulations to make wage reports due at the end of the month. Massachusetts was the only state with a due date of the 15th of the month.
New Hire Reporting
Maryland SENATE BILL 541 added wage and health insurance information to new hire reports, effective October 20, 2001. The NPRC will meet with the agency in November.
